The answer to the question whether it is lawful to waive a patient copayment is nuanced and depends upon the facts specific to each case. As a general matter, routine waiver of the copayment amount raises legal concerns, particularly with respect to Medicare claims. On the other hand, waiver of the copayment amount on an individualized basis in cases of hardship is probably lawful.
